Australian wine author and educator Jayne Powell has won her court case against the French-based committee for Champagne, CIVC.

The court case began a number of months ago, with CIVC alleging that Jayne Powell had been misleading members of the public by promoting sparkling wines under her Champagne Jayne trademark.

CIVC said Powell had “damaged the goodwill of the Champagne sector” and wanted Powell’s trademark, website and social media accounts to be taken down.

The case was heard by the Federal Court in Melbourne, but judge Justice Jonathan Beach dismissed CIVC’s allegations, saying that the case was not strong enough to rule that Powell’s entitlements should be revoked.

Justice Beach did however say that there were concerns around the way Powell promoted sparkling wines under the Champagne Jayne trademark on social media and the parties are now discussing how to resolve the issue.
